I would agree that it would be possible to compensate for the license in
your fee (I do that in a way.)  This particular agreement lists it like an
afterthought.  "Our price is $X, with or without the Performing Right."

So long as composers understand what they are doing...

I have a strong suspicion this wasn't included by
accident. AMP appears to be primarily an organization
for the COMPANIES that create music for commercials. I
would imagine these ad music production companies have
little say in which stations can, or can't, air the
commercials they worked on. So, they need to have
Composers clear (in advance) any possible use on
direct license stations.

As long as the Composers are aware, and factor that
into their upfront fees, I don't see any major
screwing. Although, in a perfect world, all composers
would ban together and refuse to work for direct
license broadcasters.

The contract is written with the companies creating
commercial music, and their ad agency clients best
interest in mind. It's not intended as a boilerplate
for Composers to use.

Music library and custom composer agreements would be
different balls of wax.
