Whether the point is 'musical' or not, is moot.  ASCAP is indeed getting 
away with something here. Thanks for the link.

Case in point: In 1995, Billy Hale and 'The Forgettables' recorded a 
song that skirted the top-twenty in Western Europe on the COMSTOCK label.
The rockabilly tune "Daddy's in the Barrelhouse"  peaked at number 14 - 
in the same week Dwight Yoakam's "Pocket of A Clown" was number 15.  
Billy's band was in (Germany, Belgium) later that same year, touring for 
the Defense Dept. AFPEO.  Two out of  four local stations that we polled 
still had "Barrelhouse" on their play lists.  There was no doubt that 
the song DID receive some airplay.

As for ASCAP's bewildering 'random' sampling and calculations - not one 
penny did we receive in royalties.
In 1996, I received a royalty check -- for $1.53 -- in error, for a song 
I didn't write.  I mailed the check back with a correction note.
