the singers doing the "Ah"s and the "Oo"'s under the melody are the
ones doing the "background vocal"!"

It was told ASCAP treats those ooh ahhs as instrumental, unless
actual words are sung. Another random, arbitrary injustice from the
folks who promised transparency, and fairness for all...
Billy Hale tried this trick on his "Tales Thrice Travelled" CD:
Instead of the generic ooh ahh, in the song "Inca Sun Ritual", he
used nondescript Latin phrases, which could pass as lyric, and would
definitely qualify as song.
Billy fired ASSCAP earlier this year, and moved on to BMI. (that
was a typographical error, I meant to type "ASCAP" but my middle
finger slipped twice on the keyboard.)
We will never know if the Latin phrase would pass muster as lyric
at ASCAP. Unless, of course, someone else tries it, Andrew. Not
just as a joke, but really put it to the test. Quando paramucho, buddy.
