I've been traveling for the holidays and it ended up with my communications
with Les being a bit crazed - to clear up the confusion, I'd like to offer a
free download to all FMPRO list members of a truly amazing seminar we hosted
in LA on performing rights royalties and direct licensing a few years back.

The seminar was groundbreaking in many ways, and represented the first
gathering of PRO officials (ASCAP didn't show, of course, but BMI and SESAC
sent top officials) and their nemesis, Ron Gertz, whose company enables most
of the direct licensing that occurs by local television stations
participated as did Willard Hoyt, the head of the performing rights
negotiating committee for local stations in the US. Our panel of experts was
moderated by Mark Holden and included a distinguished group of industry
professionals who are familiar with aspects of traditional and direct
licensing:
MIKE DOWDLE - President, Non-Stop Music Library (www.nonstopmusic.com) A
composer and reformed copyright lawyer, Mike is the co-founder and President
of Non-Stop Music Library, L.C. and Non-Stop Music Publishing, Inc., and
head of business affairs for the Non-Stop family of companies. He also
serves as President of the Production Music Association (www.pmamusic.com),
whose stated mission is to bring together individual composers and
publishers of production, promotion, advertising and commercial music into a
unified organization to better represent and promote common interests and
concerns and to assert positions on behalf of its membership.
WILLARD W. HOYT - Executive Director, Television Music Licensing Committee A
former board member of BMI, broadcast executive Willard Hoyt serves as
Executive Directory of the Television Music Licensing Committee, which
negotiates music licensing fees on behalf of local television broadcasters
across the country with ASCAP, BMI and SESAC. Hoyt is an attorney and CPA,
and has worked as an Associate Professor at the Telecommunications school at
Ohio University in Athens. He is a past member and chairman of the
Television Music Licensing Committee, and was asked to return to serve as
Executive Director of the committee in June of 2002.
PAT COLLINS - Then Senior Vice President of Licensing, SESAC
(www.sesac.com), now President of SESAC, Pat Collins, the Senior Vice
President of Licensing for SESAC, Inc. and a member of the Board of
Directors, has executive oversight of all licensing efforts at SESAC,
including those of the Broadcast, Cable, General, Satellite and Internet
Licensing throughout the United States. Pat joined SESAC in mid-1995 after a
22-year career at ASCAP, where he directed ASCAP's General Licensing and its
National Sales.
RON GERTZ - President and Founder, Music Reports, Inc.
(www.musicreports.com) As a broker of music rights between broadcasters and
copyright owners (including composers and songwriters), Music Reports, Inc.
(MRI) is engaged in music copyright research, clearance, licensing and
royalty accounting activities for radio and television broadcasters, cable
and satellite services, music subscription services and other media
companies. MRI maintains one of the largest databases of music copyright
information in the world and has developed proprietary systems to track
music use, calculate license fees and royalties and generate statistics on
music use across various media. Mr. Gertz participated via phone from New
York.
ALISON SMITH- Senior Vice President, Performing Rights, BMI. (www.bmi.com)
At Broadcast Music, Inc., Alison Smith is an integral part of the executive
team that oversees the BMI royalty system, both foreign and domestic. Ms.
Smith has added to her responsibilities the management of the
Writer/Publisher Administration & Research Departments, as well as chairing
or otherwise contributing to various BMI internal committees towards the
development of secured online digital tools. Having joined BMI in 1985, Ms.
Smith continues to work tirelessly for the benefit of BMI affiliates and
music clientele.
Les is working on a "highlights" audio that focuses on some critically
important things said by the speakers, but if you've got the time, it's a
great listen. It makes it absolutely crystal clear that payment rates for
song vs. score are absolutely NEVER part of negotiations with the
broadcasters for performing rights royalties, and that these whopping rate
differences are purely a creation of the PROs. In fact, the broadcasters,
who in the big picture are actually OUR clients as they're performing OUR
music with a license from our middlemen, the PROs, have a serious concern
that the money that they pay is not getting to the right people. Seems that
puts broadcasters and composers on the same page!
