So this discussion could be taken to another level...
What's the difference from a legal perspective between a looped sample of
one note, and a looped sample of multiple notes, and a looped sample of a
drum beat?
At what point does a loop become a separate composition, and compositions
utilizing loops and samples become derivative works?
This was an important issue that came up when watermarking became a hot
topic of discussion, because of the ramifications of what would happen if
digital sample loops and libraries were watermarked, then the compositions
that created them were watermarked again, etc..
