PRS / MCPS and PPL confusion in relation to the PMN?

 PRS / MCPS and PPL confusion in relation to the PMN?
I'm a bit confused.

The Podsafe Music Network is a great assett I think we all agree?

However, when an artist signs to a publishing deal their works  
(future and past) come under the PRS banner of public performance  
royalties. So if and when their audio is played in public -  
kerrching! (PRS look after public perfromance broadcasting etc)

Usually they sign at the same time into a MCPS contract which means,  
MCPS gets out a spy glass to look if anyone has copied any track in/ 
onto a program of any media type and if so, they charge you a fee and  
so kerrching! (MCPS look after the 'copying' and 'distributing' of  
the music)

Then if they are lucky enough to sign to a record lable, the PPL  
nazis usually need to be approached to see if the record company  
approve of you using the music in whatever format you hoping to use  
it for. Keerrching! (PPL look after the interests of the record company)

That's my understanding of the situation.

So it is great to have Howard Jones, James Brown, Miloko and Pete  
Townsend (and the like) now putting their tracks on the PMN, but  
surely they will still be members of the aforesaid organisations, and  
as such, anything they produce and we 'copy' into our podcasts, which  
then get 'played' in public are in breech of the appropriate  
copyrights and licenses?

Just because 'they' have put the stuff up there (which they are free  
to do of course - no restrictions apply) and we 'assume' it is all  
'podsafe' can anyone (Dean?) shed any light on the legal aspects of  
this situation?

Have I got it right, or are we in this 'lets not open this can of  
worms' arena currently?

Yes - it is a bit of a mess. PRS are definitely working on changes to  
their agreement to accomodate "social media". Meanwhile, nobody is  
being sued.
