A legal solution would require, as you said, resources, unless one could find
pro bono or foundational help. DOJ could be also be brought in through political
iniative through House member or Senator or possibly through the CA
Attorney Generals Office.
Perhaps a Complaint could include both ASCAP and BMI, indicating the problem
is not limited to one agency but is an industry-wide problem. Maybe a petition
would help. Since democracy doesn't seem to be providing any relief it would seem
an adjudicative body would have to look at the situation either through legal or
political initiative.
It would certainly seem some legal trespass is underway; if nothing else property,
whether monetary or intellectual, is pretty well protected under American law. If you
are getting ripped off you are getting ripped off. Relief should be possible.
