well from how I understand it the problem is that background vocal gets paid at 100% and background instrumental gets paid at 20%. And as background instrumental music is most music on tv and film there is a lot of moula not getting spread fairly. So what I am trying to understand is do you want backgrounds to all be equal and visuals to all be equal and you are ok if they are different pay rates as long as the 2 categories are paid together (backgrounds the same, visuals the same)
As for background vocal paid as visual, your argument "If people are listening to the lyrics, isn't it in the foreground?"
Possibly, but if people are listening to the music isnt it in the foreground also? Who is to say when the audience is or is not listening? All we can clarify is that visual means the audience SEES the performer and background the audience does NOT SEE the performers on the screen
